There seems to be confusion when dealing with ICBC. There are many people who believe they are going to receive compensation for their injuries when they are at fault.

The answer is yes you can receive compensation for your injuries if the other party is partially responsible. But if you are deemed to be 100% at fault for the accident ICBC will not compensate you for wages that you have lost from work or compensation for your suffering.

This is why sometimes it is important to have witnesses who can confirm your statements especially when the other party is at fault. If you don’t have any witnesses to collaborate your statements then it’s your word against the other parties, then this is up to the adjusters at ICBC to see who they will believe, and many times they will attach partial responsibility to both parties.

If you feel that the accident was completely caused by the other driver, we could help you with your case. We will review the facts of how the accident occurred, work with you in tracking down any potential witnesses if any and either have ICBC reverse their decision or increase the other person’s liability for the accident. This will increase the compensation for your injuries.

If you’re deemed to be 50% liable for the accident ICBC will only pay 50% of the award you’re awarded.

If you are 100% liable for an accident resulting in injury, ICBC will only cover medical expenses and you will not be compensated for any pain and suffering.
